These Terms of Service (Terms) govern your use of the DMC Cycles website (dmccycles.com.au), our parts store, and any custom motorcycle build or commission work you engage us for (together, the Services). By using our website, placing an order, or engaging us for a custom build, you agree to these Terms. If you do not agree, please do not use the Services.

Who we are

Nothing in these Terms limits your consumer rights

Nothing in these Terms is intended to exclude, restrict, or modify any right or remedy you have under the Australian Consumer Law, including the consumer guarantees that apply to goods and services. Where any term in this document would otherwise have that effect, it does not apply to the extent it is inconsistent with the ACL.

Parts store purchases

Ordering and payment

When you place an order through our store, you're making an offer to purchase, which we may accept or decline. Payment is processed securely through Shopify's payment infrastructure at the time of order. We take reasonable care to display accurate pricing and product information, but errors can occur. If we discover a pricing or listing error after you've placed an order, we will contact you before proceeding and you may choose to continue at the corrected price or cancel your order for a full refund.

Custom motorcycle builds and commission work

Quotes and scope

Custom build work is quoted individually based on a consultation with you. A quote is not confirmed until you accept it and pay the required deposit. The scope of work, parts, and standards described in your individual build agreement take precedence over general statements on this website.

Deposits and payment schedule

Custom builds require a deposit to commence, with further payments due at agreed milestones or on completion, as set out in your build agreement. Deposits reflect costs already committed on your behalf and are treated as described in our Return and Refund Policy.

Changes to scope

If you request changes to a build after work has commenced, we will let you know if this affects the price or timeline before proceeding. Significant changes may require a revised quote.

Timeframes

We provide estimated timeframes in good faith based on the scope of work and parts availability at the time of quoting. Timeframes may be affected by machining results, parts sourcing, or third-party suppliers (such as vapour blasting or chrome plating), and we will keep you informed of any material delays.

Ownership of the motorcycle during the build

Unless otherwise agreed in writing, the motorcycle and any parts supplied by you remain your property throughout the build. Parts and materials we source and fit as part of the build become part of the motorcycle once fitted and paid for.

Intellectual property in custom designs

Design concepts, fabrication techniques, and build documentation created by DMC Cycles remain our intellectual property, even where the finished motorcycle is your property. We may photograph and use images of completed builds for our own marketing and portfolio purposes unless you request otherwise in writing before the build begins.

Website use

You agree to use our website only for lawful purposes and not in a way that could damage, disable, or impair the website or interfere with any other party's use of it. You must not attempt to gain unauthorised access to any part of the website, our systems, or any account not belonging to you.

Accounts

If you create an account with us, you are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account. Contact us immediately if you suspect unauthorised use of your account.

Intellectual property

All content on this website, including text, images, logos, and branding, is owned by DMC Cycles or used with permission, and is protected by Australian copyright and trade mark law. You may not reproduce or use this content for commercial purposes without our written consent.

Limitation of liability

To the extent permitted by law, and subject to the Australian Consumer Law, DMC Cycles is not liable for any indirect, incidental, or consequential loss arising from your use of the website or the Services. Where the ACL applies and cannot be excluded, our liability is limited, at our option, to the resupply of the goods or services, or the cost of resupply.

Our collection and use of your personal information is described in our Privacy Policy.

Governing law

These Terms are governed by the laws of Queensland, Australia. Any dispute is subject to the non-exclusive jurisdiction of the courts of Queensland.
